RERA-registered agents cross 1 lakh nationally
India now has over 105,000 RERA-registered agents, growing roughly 19% a year. Registration is becoming the baseline for institutional work: unregistered facilitation of a sale carries penalties of ₹10,000 per day under Section 62.
What to do
If you operate unregistered, register before your next developer empanelment. Most mandates now require the number upfront.

TRAI's draft Third Amendment targets application-generated calls
The Draft Third Amendment to TCCCPR 2018 defines an A2P call as any voice call initiated by an application without direct human dialling, and requires pre-declaration to the originating access provider. It also proposes a ₹0.05 per minute A2P termination charge. Enforcement of existing rules is already severe: over 1.8 lakh telecom resources were disconnected in 2025, and a second violation brings a one-year blacklist across all operators.
What to do
If any tool dials customers automatically on your behalf, confirm it uses the 140-series for promotional calls, holds a DND scrub under 7 days old, and has been pre-declared. Five complaints in ten days is the disconnection trigger.

IT Rules 2026: synthetic audio must identify itself
In force since 20 February 2026, synthetically generated information must be clearly labelled, with audio disclosures for audio content. In practice, an AI voice agent must identify itself as an AI assistant of a named company in its first utterance, unskippably, in the language of the conversation.
What to do
If a vendor runs AI calls for you, listen to a live recording: the disclosure must be the first thing said. An agent that pretends to be human is now your compliance risk.

Data Protection Action needed
DPDP Act reaches full enforcement on 13 May 2027
The Digital Personal Data Protection Rules were notified on 13 November 2025. Consent Manager registration opens 13 November 2026, and full substantive compliance, with penalties up to ₹250 crore per contravention, begins 13 May 2027. India recognises no legitimate-interest basis: consent is the only lawful ground for outbound marketing.
What to do
Audit every lead list you message today. If you cannot produce a consent record for a contact, stop messaging them and run a re-consent campaign before the deadline. Purchased databases have no consent chain and no path to one.

MahaRERA: QR code mandatory on every advertisement
Since 1 August 2023, every advertisement for a Maharashtra project, including digital and social media creatives, must carry a QR code linking to the project's RERA page, alongside the registration number. The penalty for omission is ₹50,000. Agents must display their own MahaRERA number, and a Certificate of Competency is mandatory to practice.
What to do
Check your running Meta and Google creatives today: every Maharashtra creative needs the QR, not just the hoarding. Agents without a Certificate of Competency should enrol before renewal season.
